Spokespersons for Home and Landowners of a coastal village in Madeira, Portugal PAUL DO MAR raised at a European Commission 2 day Seminar in Funchal recently, Madeira the repossession of Private Coastal Properties all along the coast of Portugal in about 100 days! on July 1st under Portuguese MARITIME POLICY and LAW 54/2005.

Paul do Mar, first recorded in Portuguese State records as a community with private homes in the 17th century

The homes and land in Paul do Mar, a historic fishing village have been privately owned in many cases for centuries and the owners have modern ownership documents recognised by the State and have paid taxes, However, the Portuguese State will repossess any Private Homes/Land within 50 metres of the sea if the Private Home/Land owners cannot produce private ownership documents going back 150 YEARS!

To produce private ownership documents going back 150 years which are stored in Government archives is in most cases impossible and takes much time, money and effort. Legal fees to Portuguese lawyers and other professionals to discover and produce private ownership documents going back 150 years and start a lengthy legal action against the Portuguese State can run into thousands of euros with no guarantee of success!

Article 17 of the EU Charter of Fundamental Rights

Private home and land owners must “be sure that once a plot of land is bought and the ownership has been registered, then the time of ownership is unlimited and not subject to expropriation.”

Enshrined in International and European Laws is a Principle of Legal Certainty which state that an owner of a home or land in the European Union must

“be sure that once a plot of land is bought and the ownership has been registered, then the time of ownership is unlimited and not subject to expropriation.”

Spokespersons for Home and Landowners in Paul do Mar, a  historic village in Madeira, Portugal PAUL DO MAR proposed at a European Commission 2 day Seminar in Funchal recently that the European Commission must take action against all European Union Member States that are breaching European Union Laws including citizens human rights. Also, the spokespersons proposed:

-An EU Commission Impact Assessment of Member States MARITIME POLICIES and LAWS to identify in particular any breaches of EU Law against Citizens by these policies and laws

-An EU Commission Conference to identify any breaches of EU Law against Citizens by Member States MARITIME POLICIES and LAWS

– EU Commission Workshops to identify any breaches of EU Law against Citizens by Member States MARITIME POLICIES and LAWS

Madeira Government Minister, President of the Town Hall Calheta region,Madeira and political elected representative of Paul do Mar village which dates back to the 17th century speak about the crisis for many villagers who own legally homes and land next to the sea in Madeira, Portugal who cannot prove prove ownership going back 150 years impossible and/or cannot afford lawyers which cost thousands of euros.

107 days left: If the private owners all along the Portuguese coasts..many.. do not prove ownership of the land, homes going back 150 years by 1st July…the homes/land will be repossessed by the Portuguese state!

This is clearly a breach of International and Human rights laws.

Owners of Private land and homes within 50 metres of the sea and the Town Hall President of Calheta who are threatened with repossession of their homes by the State on 1st July 2014…if they do not present documents showing private ownership going back 150 years. Presenting documents showing private ownership going back 150 years costs up to several thousand euros paying lawyers and historians and in most cases impossible because the local authorities have not registered public roads on the sea fronts next to the private homes, land.

The enforcement of provisions of Portuguese Law 54/2005 is both a breach of European Human rights and European Consumer rights.

All owners of Private land and homes within 50 metres of the sea must request European Commissioner Reding to take action against Portugal to stop enforcement of the Portuguese Law 5/2005 which is both a breach of European Human rights and European Consumer rights.
