Expropriation Risk on 1st July is NOT OVER for many legal private property owners next to WATER in Portugal!

COMMENT
Since the changes were voted through on the 24th April in the Portuguese Parliament the number of private property owners including BRITS stil at risk of having their legal private property ILLEGALLY expropriated by the Portuguese State was JUST REDUCED.
BEFORE 1951
If the private legal property next to WATER in Portugal before 1951 is legal and the private property owner has the correct documents then they are exempt from the law.
AFTER 1951
But, if your property next to WATER-sea, lake, river was built after 1951 you still have to prove ownership with the correct documents dating back to 1864 and 1868!
An Article in the Portuguese Publico Newspaper is the most authoritative source that Private Property owners next to Water such as some of our neighbours whether they are in Madeira or in the Algarve or on the Lisbon coasts are still NOT OUT OF DANGER…..that if their property next to the water-sea, lake, river was built after 1951 they still have to prove ownership dating back to 1864 and 1868!
Again, some private property owners next to water in Portugal do not even know about the law! and do not understand it for example those that are old, ill and poorly educated, living and working abroad
Simple, practical guidance and advice on the law and what a private legal owner next to Water in Portugal has to do has never been able from the Government.

Private property owners in Madeira need public roads classified before 1st July, 2014 to escape ILLEGAL expropriation

The Portuguese Parliament voted for changes yesterday on the 24th April to the controversial law 

DOMINIO PUBLICO MARITIMO Law of Portugal: Lei 54/2005 (‘the Law’)

Expropriation of legal private properties by the State next to the sea on 1st July, 2014

The Portuguese Parliament voted for changes yesterday on the 24th April to the controversial law 54/2005 (‘the law’)

The changes voted for in the Parliament are subject to final approval by experts to comply with other laws such as planning and environment.

As things stand today in our village Paul do Mar, Madeira a private property owner must prove

1. private ownership of the private property with documents before 1951 

OR

2. the road between the property and the sea must be CLASSIFIED as a public road 
so their property is –not DOMINIO PUBLICO MARITIMO and not subject to Expropriation by the State in the future.

So, in the case of Paul do Mar village the private owners need the Madeiran Government to classify all the public roads before 1st July, 2014.

threatening private legal coastal homes with EXPROPRIATION by the Portugese State on 1st July 2014 along the coasts of Madeira simply because:
 
1. the legal property is within 50m of the sea
and
2. for failure to present documents proving private ownership going back 150 years which is impossible!
 
This Law of an EU member state is clearly in breach of International, European and Portuguese Law on an EU citizens rights over property! including the International and EU Treaties Portugal has signed protecting the human rights of its citizens and EU citizens in the territory.
